{"id":45897,"date":"2026-09-02T20:35:11","date_gmt":"2026-09-03T02:35:11","guid":{"rendered":"https:\/\/digitalreportmx.com\/?p=45897"},"modified":"2026-09-02T20:35:26","modified_gmt":"2026-09-03T02:35:26","slug":"plantea-pri-reformas-para-combatir-el-fraude-automotriz","status":"publish","type":"post","link":"https:\/\/digitalreportmx.com\/index.php\/2026\/09\/02\/plantea-pri-reformas-para-combatir-el-fraude-automotriz\/","title":{"rendered":"Plantea PRI reformas para combatir fraude automotriz"},"content":{"rendered":"\n<p><kbd>Monterrey, NL<\/kbd><\/p>\n\n\n\n<p>La Diputada local del PRI, Gabriela Govea L\u00f3pez propuso incorporar al C\u00f3digo Penal el delito de fraude automotriz, para sancionar a quien, sin autorizaci\u00f3n legal, ofrezca veh\u00edculos o financiamientos y reciba anticipos o mensualidades sin entregar el autom\u00f3vil en el tiempo pactado y sin causa justificada.<\/p>\n\n\n\n<p>La reforma al C\u00f3digo Penal adiciona el articulo 391 Bis para establecer una pena de cuatro a doce a\u00f1os de prisi\u00f3n, adem\u00e1s de una multa de mil a diez mil veces el valor diario de la Unidad de Medida y Actualizaci\u00f3n (UMA).<\/p>\n\n\n\n<p>\u201cEn el C\u00f3digo Penal tambi\u00e9n se contemplan agravantes cuando para cometer el il\u00edcito se utilicen oficinas simuladas, se emplee publicidad digital de los cr\u00e9ditos, la conducta se realice de manera sistem\u00e1tica o se amenace o coaccione a quienes denuncien\u201d, se\u00f1al\u00f3.<\/p>\n\n\n\n<p>Govea L\u00f3pez tambi\u00e9n propuso reformas al articulo 45 Bis y 45 Bis 1 de la Ley de Protecci\u00f3n a los Consumidores para establecer mayores controles para quienes participan en la comercializaci\u00f3n y financiamiento de veh\u00edculos.<\/p>\n\n\n\n<p>\u201cEstas pr\u00e1cticas han derivado en afectaciones econ\u00f3micas graves para cientos de familias y en una carga significativa para las autoridades investigadoras\u201d, se\u00f1al\u00f3 Govea L\u00f3pez al momento exponer en tribuna su iniciativa.<\/p>\n\n\n\n<p>\u201cLa propuesta contempla establecer la obligaci\u00f3n de que las personas f\u00edsicas o morales que ofrezcan veh\u00edculos, financiamiento automotriz o planes de pago cuenten con un registro vigente ante la autoridad financiera competente\u201d, detall\u00f3.<\/p>\n\n\n\n<p>Asimismo, la legisladora resalt\u00f3 que se busca prohibir la oferta de cr\u00e9ditos automotrices sin la autorizaci\u00f3n correspondiente y considerar como pr\u00e1ctica abusiva la simulaci\u00f3n de convenios con agencias o plataformas de venta.<\/p>\n\n\n\n<p>\u201cLa ausencia de regulaci\u00f3n espec\u00edfica y la falta de controles administrativos eficaces han permitido que estas empresas operen con impunidad y movilidad, afectando la confianza ciudadana en el mercado automotriz y vulnerando derechos fundamentales de los consumidores\u201d, afirm\u00f3.<\/p>\n\n\n\n<p>\u201cAnte la magnitud del problema y la reiteraci\u00f3n de los casos, resulta indispensable establecer mecanismos que permitan prevenir estas conductas, fortalecer la supervisi\u00f3n y garantizar una mayor seguridad jur\u00eddica para quienes realizan operaciones relacionadas con la adquisici\u00f3n de veh\u00edculos\u201d, sostuvo.<\/p>\n\n\n\n<p>La legisladora destac\u00f3 que la reforma busca cerrar espacios de impunidad y evitar que empresas fraudulentas aprovechen vac\u00edos de regulaci\u00f3n para captar recursos de las familias.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Monterrey, NL La Diputada local del PRI, Gabriela Govea L\u00f3pez propuso incorporar al C\u00f3digo Penal el delito de fraude automotriz, para sancionar a quien, sin autorizaci\u00f3n legal, ofrezca veh\u00edculos o financiamientos y reciba anticipos o mensualidades sin entregar el autom\u00f3vil en el tiempo pactado y sin causa justificada.
